Alan Blakely's Copyright, Licensing and Terms of Usage

A concise statement of terms for all photography buyers


The following licensing terms apply to architectural photography projects photographed by Alan Blakely:

"A single-party, non-transferable image license for all media with no expiration is granted to (client) upon payment in full.  Absolutely no image usage is authorized until payment in full is received. This license may not be assigned, transferred, or shared with a third party, including, but not limited to: affiliated companies or business entities, clients, contractors, sub-contractors, consultants, manufacturers, distributors, retailers, re-sellers, property owners/managers, sales agents, social media connections, friends, personal associates, etc.  Editorial fees are payable to the photographer. Alan Blakely Photography retains copyright."

The United States Copyright Act, primarily Title 17 of the U.S. Code, protects photographs as "pictorial, graphic, and sculptural works" from the moment they are created in a tangible form, with registration being optional but necessary for legal action. This protects a photographer's exclusive rights to reproduce, distribute, display, and create new works from their photos, and applies to images created by humans fixed in a tangible medium like film or a digital file.

A photo credit does not constitute a license for use!  To legally use any of Alan Blakely's photographs, you must first obtain a paid license for use directly from Alan Blakely.  No other party may legally authorize or transfer the usage of Alan Blakely's photographs, including current legal licensees of Alan's photography.  Licensing is required for all parties, regardless of whether or not the party is a government entity, non-profit organization, charitable organization, religious organization, educational institution, or any other commercial or non-commercial entity. 

A license issued for general marketing usage MAY NOT be transferred for use in advertising.  Product manufacturers must obtain a separate license to use an image for advertising purposes.

Images that are issued to the media in press releases and press kits may not be used outside of the context in which they were submitted to the media outlet.  Any use of Alan Blakely's photographs by a media outlet outside of the specific context in which they were submitted constitutes copyright infringement.

If you are using Alan Blakely's photographs without proper licensing, please contact him immediately to avoid costly legal proceedings.  Alan Blakely's legal partners will detect all unauthorized usage of his photographs in electronic and print media throughout the entire world through the use of sophisticated AI-aided reverse image searches, web spiders, and pixel-matching bots.  All unauthorized usage will ultimately be discovered and prosecuted.
